Memberships at Stowe Country Club Benefits

Terms & Conditions: Memberships at Stowe Country Club are offered exclusively for the purpose of permitting members the recreational use of the facilities. Memberships should not be viewed as an investment and no member should expect to derive any economic profits from membership at the club. A membership does not imply any right or privilege to participate in or to administer Stowe Country Club’s business policies and does not create any vested, proprietary, prescriptive, or easement rights or interests of any nature in land, Stowe Country Club, the facilities or any of Spruce Peak’s assets. A Member acquires only a revocable license to use the facilities. Any member, family member, guest or other person who, in any manner, makes use of or accepts the use of any apparatus, appliance, facility, privilege or service whatsoever owned, leased or operated by the Club, including without limitation, the use of golf carts, or who engages in any contest, game, function, exercise, competition or other activity operated, organized, arranged or sponsored by the Club, either on or off the Club’s premises, shall do so at his or her own risk. The member and his or her family members and guests shall hold the Company, any manager of the Club Facilities, their affiliates, their successors and assigns and their respective shareholders, partners, directors, officers, members, employees, representatives and agents (collectively, the “Indemnified Parties”) harmless from any and all loss, cost, claim, injury, damage or liability sustained or incurred by him or her, resulting from the use of the Club Facilities, including without limitation, the wearing of golf shoes with soft spikes or spikeless shoes, or otherwise, arising out of or incident to membership in the Club and/or from any act or omission of any of the Indemnified Parties. Any member shall have, owe and perform the same obligation to the Indemnified Parties hereunder in respect to any such loss, cost, claim, injury, damage or liability sustained or incurred by any guest or family member.

Should any party bound by these terms bring suit against any of the Indemnified Parties in connection with any event operated, organized, arranged or sponsored by the Club or on any other claim or matter in connection with membership in the Club, and fail to obtain judgment therein against any one or more of them, said party shall be liable to the prevailing Indemnified Parties for all costs and expenses incurred by them in the defense of such suit, including court costs and attorneys’ fees and expenses through all appellate proceedings.

Release: Completion of this form serves as a release for Spruce Peak, Stowe Country Club, The Club at Spruce Peak and The Lodge at Spruce Peak, licensees, and successors from any claims that may arise regarding the use of my image, including any claims of defamation, invasion of privacy, or infringement of moral rights, rights of publicity, or copyright. Company is permitted, although not obligated, to include subjects name as a credit in connection with the image.

Cancellations & Closures: Maximizing the use of available tee times during weekends and other high demand periods is critical for successful operation of the Club, if unable to make a scheduled tee time, please cancel 24 hours or more in advance. The Club reserves the right to suspend reservation or playing privileges of those members who repeatedly no-show for tee times or do not cancel with appropriate notice. Payment of dues by members is a continuing obligation of membership, which is not dependent upon the availability of all of the Club Facilities, or the frequency of use. Repair, maintenance and/or construction or remodeling of any of the Club Facilities and/or other occurrence or event (including, without limitation, acts of God, natural disasters, pestilence, weather, disease, other unanticipated cause, or requirements imposed by governmental authorities, whether within or beyond the control of the Club), may make it necessary for the Club to change the hours of use, or to restrict the use of one or more of the Club Facilities or portions thereof, or to close the Club temporarily. Dues shall not be reduced or suspended during the time when the Club Facilities, in whole or in part, are not available.

Member Billing: Member billing is available only in the SCC Golf Shop and restaurant. A valid credit card is required to activate an account and will be used to settle billing charges at the end of each month. If a member fails to pay any club account within 30 days of when it is first billed, the Club shall send written notice to the member of the delinquent balance.  Should a delinquent balance not be paid within 60 days of the original billing date the Club shall have the right to suspend charging privileges in the Club.  Should a delinquent balance not be paid within 90 days of the original billing date the Club shall have the right to suspend membership privileges in the Club at any time until the delinquent account is paid in full. Continued delinquency for a period of 120 days from the date a club account is first billed or more than one incident of delinquency by a member may result in termination of membership in the Club as determined by the Club in its discretion.  A member who possesses multiple membership accounts and holds at least one membership account that becomes delinquent shall be considered delinquent in all membership accounts and all membership privileges shall be managed according to this section by the Club in its discretion.

Refund Policy: Before the first day of operation, refunds may be issued for medical reasons with proper verification or relocation more than a 50 mile radius from the Club property.  After the first day of operation, refunds may be issued for medical reasons only with proper verification. The amount of the refund is calculated based upon the following schedule: 1-30 days of operation – 50%, 31+ days of operation – 0%. Please allow 6-8 weeks for processing.
